Three-Year Health Guarantee

Health Guarantee

All puppies receive a thorough veterinary exam and a clean bill of health before they go to their forever homes.

All puppies receive excellent nutrition throughout their time at Harris Havanese.

All puppies and adults alike are raised in a loving environment inside our home surrounded by our family and receive plenty of outdoor play.

All of our puppies are very well-socialized, truly loved, well-cared for, and played with throughout the day. We feel that raising them in our home makes all the difference in preparing them for their new home with you. My children and I are home with them every day. They are wormed on weeks 2, 4, 6, and 8. Puppies are given a thorough veterinary exam at 8 weeks of age when they receive their first set of vaccinations. We begin potty training and crate training at 4 weeks of age to make the transition to their forever homes as easy as possible.

Health Guarantee & Spay/Neuter Contract

Buyer’s Responsibilities:

Provide puppy with routine preventive care. To provide this health guarantee, we do require that you abide by and be able to prove a few requirements, should we ever need to honor this guarantee.

The purchaser must have the puppy examined by a licensed veterinarian within 5 business days of its arrival at your home. If the veterinarian discovers the puppy to be unsound, it can be returned for another puppy of equal value as soon as a new puppy is available. This is provided that the puppy be returned within five days and be accompanied by a letter from the examining veterinarian stating in what respect the puppy is unsound. Harris Havanese will not be liable for any expenses, including but not limited to, veterinary bills, or shipping expenses. The guarantee will be VOID if the buyer fails to have the puppy examined by a licensed Veterinarian within the allotted time frame.

Routine Veterinary Exams / Vaccinations

Yearly veterinary exams/vaccines are required for this guarantee to be honored and records must be shown for proof. A necropsy must be done on any deceased dog/puppy. This guarantee is null and void upon any evidence of abuse or neglect, or if the buyer fails to maintain annual check-ups with a qualified veterinarian. Proof of said maintenance must be furnished upon request. This guarantee is non-transferable.

The Buyer must follow all veterinarian guidelines for vaccinations and de-worming. It is your responsibility to make sure the puppy is vaccinated at the appropriate age. If your puppy is exposed to parvo and/or distemper before the full vaccine series is completed, he/she can be susceptible to these viruses. Harris Havanese is not responsible for the health of the Puppy after 5 days have passed.  After the puppy leaves our property he/she may become infected by a communicable disease while in the care of its new owner. Harris Havanese will not be responsible for a puppy's health if he/she is given a vaccine w/ Lepto, due to fatal side effects to small breed puppies, or re-vaccinated before 11 weeks of age.

We strongly recommend you keep your new puppy on its familiar food. Failure to do so could result in diarrhea, loss of appetite, hypoglycemic attacks (low blood sugar), or a combination of these symptoms.

Toy-size puppies need to eat several times each day and giving a small amount (size of a dime or less) of Nutra-Stat or Nutra-Cal is recommended 1-2 times per day. Failure to have Nutra-Stat or Nutra-Cal on hand could also result in the death or serious harm to your new puppy if they do have a hypoglycemic attack.  Also, it is very important to keep small-breed puppies warm. Hypoglycemia is preventable and is not included in the guarantee.

The Buyer has researched and is knowledgeable of the non-life threatening problems that a Havanese may have, and agrees that these are not covered under this health guarantee.  Minor, breed related, treatable, or correctable conditions such as Patellar Luxation, or a puppy murmur, or any condition that may go away or is considered to be a condition which a puppy will likely outgrow are not covered.  Under no circumstances will Harris Havanese be responsible for veterinarian bills acquired by the buyer for this puppy.

With a new puppy come extra responsibilities. Failure to follow these guidelines could put your puppy in serious danger.

Three-Year Health Guarantee against Genetic Defects:

To the best of my knowledge I am selling a healthy puppy: I only sell puppies that have been deemed healthy by a Licensed Veterinarian.

The above puppy is guaranteed until three years of age against fatal congenital disease which adversely affects the health of the animal. This includes kidney, heart, pancreas, spine, and liver problems of a severe life threatening nature. If the dog dies within this three year time frame, the buyer will pay to have it autopsied by a licensed veterinarian to ascertain reason. If reason is congenital, the Seller will replace the puppy. All veterinarian findings must be submitted and signed by a licensed Veterinarian and be sent on the Veterinarian's letterhead and backed up with lab work or x-rays as to the nature of the problem. A second opinion may be requested.

Seller will not pay or be responsible for any surgery or veterinarian bills.

A puppy with a defect must be returned to the seller within 14 days of diagnosis to qualify for a replacement puppy. A dog will be replaced as follows: The dog must show the defect by three years of age. Breeder must be notified of the problem within 5 business days of the licensed veterinarian’s determination. Breeder must be provided a full copy of all veterinary records from the veterinarian’s office and receive a release to all veterinary records. The Breeder has the right to have this animal examined by a veterinarian of their choosing. If a dispute over the diagnosis occurs, a third mutually agreed upon veterinarian will make the final determination. The Breeder will provide a replacement puppy of equivalent value. No refund in part, or full will be given, only a replacement dog. No replacement puppy will be given if the puppy has been bred or euthanized without Breeder’s permission. A returned puppy must be returned to the seller in good, other than the specified problem, at the buyer's expense condition along with AKC papers and all records. The owner will then qualify for a replacement puppy. Buyer is responsible for transportation costs to and from the seller on a replacement puppy. Seller will not pay or be responsible for any veterinarian or surgery bills. Moreover, if you decide to keep and treat a pup with a genetic defect or an ill puppy, seller will void all aspects of this contract. Replacement puppy will be mutually agreed upon by both parties and will be of comparable quality. It is understood that the replacement puppy may not be from the exact same parents of the original puppy. NO replacement puppy will be covered under this guarantee if the puppy has sired or whelped one or more pups.

Seller will not be responsible for any medical bills or medical expenses. Buyer is aware that owning a puppy means trips to the veterinarian and understands that he/she will be responsible for all Vet bills.

As of the date of delivery, the puppy has received proper vaccinations and worming. A DETAILED RECORD OF YOUR PUPPY'S HEALTH & VACCINATIONS IS INCLUDED IN YOUR PUPPY PACK. PLEASE TAKE THIS WITH YOU TO YOUR FIRST VISIT TO YOUR VET TO MAKE SURE YOUR VET DOES NOT GIVE A VACCINATION THAT HAS ALREADY BEEN GIVEN! Vaccination must be no less than three weeks apart and no more than four weeks apart for a series of three. Rabies vaccines cannot be administered before 16 weeks of age. If you allow your veterinarian to do any of these vaccinations too early, your guarantee is void. Also, I will not be responsible for a puppy's health if he/she is given a vaccine w/ Lepto, due to fatal side effects to small breed puppies, or re-vaccinated before 11 weeks of age. Proof of said maintenance must be furnished upon request of breeder.

This guarantee does not cover the treatment of common ailments such as yeast infection, kennel cough, or parasites such as mites, roundworms, hookworms, whip worms, tapeworms, giardia, or coccidiosis, which are common to growing puppies and can be contracted from soil, pet stores and many other places. Your puppy has been wormed frequently from two weeks of age until your possession and even though our puppies are tested and dewormed at an early age, it is possible (though unlikely) that they may still have parasites at the time of sale. It is your responsibility to continue to worm your puppy and check for parasites, including Heartworm. Harris Havanese will not be responsible for adverse reactions to Heartworm Preventatives.

No guarantee is given for hypoglycemia (low blood sugar). This condition is not hereditary and is very preventable.

There are certain disorders that may be caused by environmental factors, for example: allergies, thyroid dysfunction, démodé tic mange, and other autoimmune disorders that are not covered by this guarantee. Physical problems that are or could be the result of injury, abuse, neglect, or if the buyer fails to complete vaccinations and puppy checks by a qualified Vet, are not covered under this guarantee.

Although our puppies are bred to AKC standard, and most have excellent conformation, we can make NO guarantees of "Show Quality.”  Our main concern and objective is to raise beautiful, healthy companions.  We also cannot guarantee adult size, color or temperament. While we do our best to give an accurate adult weight, there is absolutely NO GUARANTEE that the puppy will be the estimated size, or color. Coats and color may change. There is no guarantee or warranty that the Buyer will be able to show or breed the puppy regardless of show or breeding potentials. Retained testicles, umbilical hernias, and bad bites as the dog matures are not covered this guarantee.

SPAY/NEUTER CONTRACT:

Buyer agrees Puppy is being adopted as a family pet and will never be used for breeding. Seller requires all puppies to be spayed/neutered by 10 months of age at Buyer's expense. Seller agrees Puppy will not be used for breeding and will provide Seller with written proof of said spay/neuter within 7 days. This procedure must be performed by a Licensed Veterinarian and documentation must reflect the same. Buyer understands failure to provide proof of sterilization once the Puppy reaches 10 months of age, will result in nullification of this contract, and void all contents thereof including the Health Guarantee.

Buyer further understands, any attempt on the part of the Buyer to use the Puppy in a breeding program will result in legal action for breach of contract. Should such actions take place, any/all legal fees associated with this matter will become the responsibility of the Buyer to include any/all Seller attorney fees. Any such litigations shall occur in the State of California, in the county of Los Angeles. Any/all expenses related to travel will also be at the Buyer's expense.

If the BUYER fails to comply with the Non-Breeding Agreement and a litter is produced by the PUPPY/DOG, the BUYER understands that the SELLER will have the intent to pursue suit against the BUYER for the monetary value of each and every puppy produced. The monetary value for each puppy will be equal to the purchase price of the PUPPY/DOG.  Purchase Price: _________.

By my signature below, I agree to have this dog spayed/neutered by no later than 10 months after its whelping date/date of birth, and I understand that this spay/neuter agreement is an agreement that this dog will not produce a litter of puppies either purposely or accidentally.

The guarantee applies to the original puppy only and is nontransferable to a second party. This contract supersedes any and all previous agreements. This contract is null and void if the terms and conditions are not fulfilled and proof of conditions provided.

Buyer agrees to first contact the Seller if they find they are no longer able to care for their Puppy. If Buyer cannot find suitable home for their Puppy then Buyer will return Puppy to Seller. Buyer will transfer AKC ownership back to Seller. Transportation expenses will be the responsibility of the Buyer and no refund will be given to Buyer.

Buyer agrees that he/she understands this contract fully, and that this contract is under the jurisdiction of the State of California, in the county of Los Angeles. It is agreed that the place of venue shall be in Los Angeles County, California. Liability shall be limited to the the adoption fee paid and listed on page one of this contract.
